General terms and conditions for bike rental and bike tour

Bikely Barcelona is committed to protecting your personal data and privacy. This Privacy Policy outlines how we collect, use, and safeguard your information when you interact with our website and services.

Rental Period

- The rental period begins at the time of pickup and ends at the agreed return time.

- Late returns will incur additional charges

- Bikely/Kick&Roll is not obliged to give any refund for rented bikes that are returned before the end of the contractual period.

- The rented bikes will be picked up at Bikelly office (Carrer Llull, 11) and must be returned to the same place of collection (or at any other location only with prior agreement between both parties) during the opening hours.

Payment Methods & Guarantee Deposit

- Payment for both the bike/kickbike rental and the bike/kickbike tours need to be done in advance.

- An deposit is needed for each bike/kickbike. The deposit consists of: For city bike and kickbike a photocopy of a valid ID and 50€ in cash. For E-bike a photocopy of a valid ID and 150€ in cash.

- The amount will be fully refunded when the Bycicle is returned in the same condition it was delivered.

Use of equipment

- Bicycles must be used responsibly

- Bicycles may not be used for racing, off-road riding, or stunts

- The customer must follow all local traffic laws and regulations

- By renting a bicycle or joining a bicycle tour, the customer declares to be:

  • In good physical condition,  not suffering from any medical diseases or complaints that influence their riding ability.
  • Able to properly ride a bicycle.

- Bikely reserves the right to judge the capacities and abilities of a customer or rider prior to the use of a bicycle.

- The customer/rider must behave as a good renter/rider, which means he:

  • Is not permitted to sublet or sublease the bicycle.
  • Is not permitted to give the bicycle to a person other than the rider.
  • Is not permitted to take the bicycle outside of Barcelona.
  • Is not permitted to ride on a bike with more than 1 person.
  • Must ensure that the person who is contractually indicated as the rider is legally permitted, and physically and mentally fit enough to ride a bicycle.
  • Must secure loads on the bicycle with due care.
  • Is not permitted to continue using the bicycle if it’s damaged, when its use can lead to aggravation of the damage or affects traffic safety.

- Customers must never leave the bicycle unattended unless properly locked.

- At the start of the rental or tour, the customer needs to check the bicycle and report any possible defects to Bikely staff. When the defect(s) cannot be repaired instantly, the customer is permitted to have a replacement bike. As soon as the customer leaves the Bikely shop, he accepts the condition of the bicycle.

- An case any problems with the bicycle occur in Barcelona, the customer needs to bring back the bike to the shop. Bikely does not reimburse any repairs performed by other companies.

- In the event of injury to the customer and/or damage or loss of the bicycle, the customer is obligated to:

  • Inform Bikely as soon as possible
  • Follow instructions from Bikely.
  • Provide all (requested) information and documents that relate to the event that caused the injury/damage.
  • Not leave the bicycle behind without properly securing it.
  • Report the event to the local police.
  • Submit a fully completed and signed claim form to Bikely as soon as possible.

Damage or Loss

- The customer is liable for any damage, theft, or loss of the bicycle and accessories during the rental period.

- In the event of damage or loss, repair or replacement fees will apply.

- The customer must respect all rules and regulations. The customer uses the bicycle on his own responsibility. If customer infringes any Spanish rules or regulations, Bikely will not be held responsible under any circumstances.

- In the event of loss, theft, or damage of the bicycle, Bikely is entitled to charge a (maximum) compensation of:

  • 150€ for a normal bicycle, 150€ for a kickbike and 1500€ for an e-bike.
  • For damaged parts of a e-bike saddle 25€, lights set 55€, chain case 15€, luggage rack 10€, bell 5€, key for lock 25€, gear changer 15€, entire back wheel 80€, entire front wheel 70€, e-bike battery 470€, e-bike charger 150€, and wheel with electrical engine €500, Phone holder 25€
  • Accessories; helmet 25€, lock 35€.

Assurance

- Bikely offers an assurance service, which assures customers less financial risks in case of damage to, or theft of, the bicycle.

- Assurance costs:

  • For normal bikes and kickbikes: 1-4 hours 2€, 24 hours 3.50 €.
  • For E-bike: 1-4 hours 5€, 24 hours 8€.

- The assurance service covers partly theft and all sorts of damage of the bicycle

Personal Data

- Personal data of the customer will be processed by Bikely according to the European Union General Data Protection Regulation. By processing these data Bikely can carry out the contract, provide customer and/or rider with the best service and make personalized offers. The customer can request inspection or correction of his personal data and file objections. Objections by the customer regarding the processing of data for direct mailing will be honored at all times.

Applicable Law

The contract is governed by Spanish law.
